The following Terms of Use (“Terms”) apply when you choose to add, attempt to add, or keep an eligible Citizens National Bank Debit Card (“Card”) in a Mobile Wallet (“Wallet”) on any device that supports a Mobile Wallet. In these Terms, “you” or “your” refers to the Citizens National Bank Cardholder or any authorized user of the Card. “We,” “us,” “our,” and “Citizens National Bank” refer to Citizens National Bank enrolling your Debit Card into a Mobile Wallet which constitutes acknowledgment and agreement to these Terms.
1. Mobile Wallet Enrollment
You can add an eligible Citizens National Bank Debit Card to a Mobile Wallet by following the instructions of the Wallet provider. For you to be authorized to use your Card within the Mobile Wallet, you must not be restricted from using the Wallet based upon any limitations imposed by the Wallet provider, your wireless service provider, and/or any third party associated with these providers. When you add a Citizens National Bank Debit Card, the Wallet allows you to use the Card to enter into transactions where the Wallet is accepted. The Wallet may not be accepted at all places where your Citizens National Bank Debit Card is accepted.
2. Citizens National Bank Debit Card Agreement
Purchases and other transactions you make with a Citizens National Bank Debit Card are governed by the Account Agreement provided to you at account opening and amended from time to time. The agreement remains in full force and effect regardless of whether or not you use the Digital Wallet service. The Wallet simply provides another way for you to make purchases with your Card and will be considered the same as if you had used your Card in person to conduct the transaction.
3. Fees
Please consult your Account Agreement for any applicable interest, fees, or charges that apply to your Card. We currently do not charge any additional fees for adding your Card to the Digital Wallet or using your Card in the Wallet. We reserve the right to institute charges for account access or for additional transactions or features in the future, but only after written and/or electronic notification to you at least 30 days in advance of the date such charges will take effect. You are responsible for any fees charged in connection with the use of your mobile device or the Wallet that the provider and other third parties such as wireless companies or data service providers may impose.
4. Use of a Mobile Wallet
Citizens National Bank does not own, operate, or control the Mobile Wallet. We are not responsible for providing the Wallet service to you. We are only responsible for supplying information securely to the Wallet provider to allow usage of the Citizens National Bank Debit Card in the Wallet. We are not responsible for any failure of the Wallet or the inability to use the Wallet for any transaction. We are also not responsible for any loss, injury, or inconvenience you incur as a result of a merchant refusing to accept the Wallet.
5. Device Eligibility
You are required to have an eligible mobile device to use this service. Devices which have been unlocked in an unauthorized fashion (“jail-broken”) or otherwise modified are not eligible to use a Mobile Wallet. You acknowledge that use of an ineligible mobile device with the Mobile Wallet service is expressly prohibited, constitutes a breach of these Terms, and is grounds for us to temporarily suspend, permanently terminate, or otherwise deny further access to your Card in the Wallet. We are not liable to you for the effects (third party or otherwise) of such termination or suspension.
6. Security
You are solely responsible for maintaining the confidentiality of your User ID, passwords, and any other means that you may use to securely access the Wallet on your mobile device. If you share these credentials with anyone, that person may be able to use your Wallet to make purchases or obtain access to your personal and payment information available through the Wallet. The Mobile Wallet provider is responsible for the security of information provided or held by the Wallet. We are not responsible if there is a security breach affecting any information held or sent from the Wallet.
7. Report Lost or Stolen Devices or Cards
You agree to safeguard your mobile device at all times and not leave it unattended. If your device is lost, stolen, or you have reason to believe that your device has been compromised, including your fingerprint reader, PIN, or another security device, you agree to contact us immediately so that we can take action to disable your Card for use within the Wallet. Given that your device can be used like a Card to make purchases, you must notify us in the event your device is lost or stolen with the same urgency as if your actual Card is lost or stolen. If you fail to notify us, you may be liable for all or a portion of the losses associated with unauthorized use of your Card whether that use was through the Wallet service or not.
8. Removal or Cancellation
You should contact the Mobile Wallet provider for instructions on how to remove a Citizens National Bank Debit Card from the Wallet. We may cancel, block, or suspend use of your Card in the Wallet from purchases at any time and for any reason, such as if we suspect fraud with your Card, if you have an overdue or negative balance on your account, or if applicable laws change.
9. Account Ownership and Information
You represent that you are the legal owner of the account(s) and other financial information which may be accessed via a Mobile Wallet. You represent and agree that all information you provide to us in connection with the Wallet is accurate, current, and complete and that you have the right to provide such information to us for the purpose of using the service. You agree not to misrepresent your identity or your account information. You agree to keep your account information confidential, up-to-date, and accurate. You represent that you are an authorized user of the mobile device you will use to access the Wallet.
10. Electronic Communication
You consent to receive electronic communications and disclosures from us in connection with your Citizens National Bank Debit Card and the Wallet. You agree that we can contact you by email at any email address you provide to us in connection with your Citizens National Bank account. You agree to update your contact information with us when it changes.
11. Change of Terms
We may change, add, or delete any terms, at any time, by changing these Terms of Use or your Account Agreement. We will provide advanced notice of these changes if required by law. You agree to any such changes by continuing to keep a Citizens National Bank Debit Card in the Wallet. You cannot change these Terms, but you can terminate these Terms at any time by removing all Citizens National Bank Debit Cards from the Wallet. We reserve the right, at our sole discretion and at any time, to discontinue or terminate this service or access to your Card by a Mobile Wallet.
12. Privacy
We respect the privacy of our customers and are committed to treating customer information responsibly and in a manner that is consistent with the privacy policy applicable to your Citizens National Bank Debit Card or the underlying account. You agree that we may collect, transmit, store, and use certain information about you and the use of your Card in the Mobile Wallet. You acknowledge that we may share your information with the Wallet provider, a payment network, and others in order to provide the services you have requested, to make information available to you about your Card transactions, and to improve our ability to offer these services. You understand that we do not control the privacy and security of your information that may be held by the Wallet provider or any other third party and that are governed by their respective privacy policies.
13. Indemnity
You agree to indemnify, defend, and hold Citizens National Bank harmless from and against any and all claims, actions, damages, liabilities, costs, and expenses, including reasonable attorney fees, arising out of your use of the Mobile Wallet service, any negligent or intentional action or inaction, and/or any breach of the Terms of Use. You agree that this paragraph shall survive the termination of these Terms for any reason.
